01Acceptance of Terms
By accessing, subscribing to, or using the Emerald Stream IPTV service ("the Service"), you ("the User", "you", or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.
These Terms constitute a legally binding agreement between you and Emerald Stream ("we", "us", or "our"). Your continued use of the Service following any updates to these Terms constitutes your acceptance of those updates.
By using Emerald Stream, you confirm that:
- You are at least 18 years of age (or the legal age of majority in your jurisdiction)
- You have read and understood these Terms in full
- You have the legal capacity to enter this agreement
- You agree to comply with all applicable local, national, and international laws
02Definitions
For the purposes of these Terms, the following terms have the following meanings:
- "Service" means the IPTV subscription service provided by Emerald Stream, including playlist credentials, server access, and customer support.
- "Subscription" means the paid access plan you purchase to use the Service.
- "Credentials" means the username, password, and server URL we provide for accessing the Service.
- "Player App" means any third-party application (such as IPTV Smarters Pro, Smarters Player Lite, TiviMate, IBO Player, etc.) used to play streaming content. These apps are NOT owned, developed, maintained, or controlled by Emerald Stream.
- "Device" means any hardware (smartphone, tablet, Smart TV, Firestick, MAG box, computer, etc.) used to access the Service.
- "Content" means the audio-visual streams accessible through the Service.
- "User Data" means personal information you provide to use the Service (covered in our Privacy Policy).
03Description of Service
Emerald Stream provides an IPTV (Internet Protocol Television) subscription service that enables access to streaming content via the internet. Specifically, what we provide is:
- Streaming credentials — username, password, and server URL delivered via WhatsApp or email upon subscription
- Access to our content servers — the technological infrastructure that delivers streams
- Customer support — assistance with connection issues, credential resets, and server-side concerns
What We Do NOT Provide
To be absolutely clear, Emerald Stream does not provide:
- Player apps (IPTV Smarters Pro, Smarters Player Lite, TiviMate, IBO Player, VLC, or any other application)
- Hardware (Firestick, MAG box, Smart TV, smartphones, or any device)
- Internet connection or broadband service
- App updates, app maintenance, or app technical support
- Bug fixes or feature changes within third-party player apps
04Player App Disclaimer
IMPORTANT: The player apps used to access Emerald Stream's content (including but not limited to IPTV Smarters Pro, Smarters Player Lite, TiviMate, IBO Player, GSE Smart IPTV, XCIPTV, and VLC) are third-party applications developed and maintained by independent companies. Emerald Stream has no ownership, control, or influence over these apps.
What This Means for You
- If a player app stops working, crashes, freezes, or has bugs — this is not Emerald Stream's responsibility
- If a player app is removed from an app store (as happened with IPTV Smarters Pro on iOS in 2023) — this is not Emerald Stream's responsibility
- If a player app changes its interface, features, or login process — this is not Emerald Stream's responsibility
- If a player app requires an update to continue functioning — you are responsible for updating it
- We provide setup guides and basic troubleshooting for popular apps as a courtesy, but we do not offer technical support for the apps themselves
By subscribing to Emerald Stream, you acknowledge that you understand the distinction between the IPTV service (what we provide) and the player apps (what third parties provide), and you accept full responsibility for choosing, installing, updating, and maintaining your player app.
05Account & Credentials
Credential Delivery
Upon successful subscription payment, you will receive your unique credentials via WhatsApp (or email upon request) within 5-30 minutes. These credentials consist of:
- A unique username
- A unique password
- A server URL (Xtream Codes API) or portal URL (for MAG boxes)
Your Responsibilities
You are solely responsible for:
- Keeping your credentials confidential — do not share them with anyone outside your household
- Reporting any unauthorised use immediately by contacting us via WhatsApp
- Ensuring your credentials are correctly entered in your chosen player app
- Not attempting to share credentials across more devices than your plan permits
Note: Sharing your credentials with multiple users outside your household constitutes a violation of these Terms and may result in immediate account suspension without refund. Our system can detect concurrent streams beyond your plan limits.
06Subscription & Billing
Subscription Plans
Emerald Stream offers various subscription plans based on the number of devices and duration. Current pricing is displayed on our pricing page and may be updated at any time. Subscription duration begins on the date your credentials are activated.
Payment
All payments are processed through our approved payment methods (which may include credit/debit cards, bank transfer, Revolut, PayPal, and cryptocurrency). Payment is required in full and in advance before credentials are issued.
Renewals
Subscriptions do not auto-renew. To continue your service after expiry, you must manually purchase a new subscription period. We will send reminders via WhatsApp approximately 7 days and 1 day before your subscription expires.
Currency & Taxes
All prices are listed in Euros (€) and are inclusive of any applicable taxes unless otherwise stated. Prices are subject to change at our discretion, though changes will not affect subscriptions already paid for.
07Acceptable Use
By using the Service, you agree to NOT:
- Use the Service for any illegal purpose or in violation of any local, national, or international law
- Resell, redistribute, sub-license, or commercially exploit your credentials or access to the Service without our prior written permission
- Attempt to reverse-engineer, decompile, hack, or otherwise circumvent the Service's technical protections
- Share your credentials beyond your immediate household
- Use the Service to harass, defame, or harm any third party
- Record, redistribute, or commercially exploit any content accessed through the Service
- Use bots, scripts, or automated tools to access the Service
- Attempt to access the Service from more devices than your plan permits
- Use the Service in any manner that could damage, disable, overburden, or impair our servers or networks
Violation of any of the above may result in immediate suspension or termination of your account without refund.
08App Updates Required
READ THIS CAREFULLY: Emerald Stream does not control the player apps you use. Player apps periodically release updates that may be required to continue accessing streaming services correctly.
Your Obligation to Update
You agree that:
- You will keep your chosen player app updated to the latest version available
- If a player app update is required to access content properly, you will install that update promptly
- You will not hold Emerald Stream responsible for content access issues caused by outdated player apps
- If you choose to delay or refuse an app update, any resulting service interruption is your responsibility
No Refund for App Update Issues
Refunds will NOT be granted in the following situations:
- You refused to update your player app when an update was available
- You are using an outdated or unsupported version of a player app
- You are using an unofficial, modified, or pirated version of a player app
- Your device's operating system is outdated and no longer supports the player app
- Your chosen player app has been discontinued or removed by its developer
09Service Availability
We strive to maintain 99.9% uptime on our streaming servers. However, we do not guarantee uninterrupted, error-free, or completely secure service. The Service may be temporarily unavailable due to:
- Scheduled maintenance (we will notify you in advance where possible)
- Emergency maintenance or security updates
- Server issues, infrastructure failures, or third-party service problems
- Force majeure events (natural disasters, government actions, internet outages)
- Issues with your internet service provider, network, device, or player app
Brief, routine maintenance and outages are normal aspects of any streaming service and do not entitle you to a refund or extension unless they exceed a reasonable threshold (typically 24+ consecutive hours of complete server unavailability).
10Refund Policy
Due to the immediate digital nature of our Service, refunds are limited. For the full refund policy, please see our Refund Policy page. Key points are summarised below:
Eligible for Refund
- Server-side technical issues that we are unable to resolve within 72 hours of being notified
- Complete server failure exceeding 24 consecutive hours within the first 7 days of subscription
- Refund requested within 7 days of subscription start AND less than 10% of subscription period has been used
NOT Eligible for Refund
- Issues caused by your internet connection, device, or player app
- Refusal or failure to update your player app
- Use of unofficial, modified, or pirated player apps
- Brief outages or routine maintenance
- Buyer's remorse or change of mind after using the Service
- Specific channels not meeting expectations (channel list is subject to change)
- Account suspension or termination due to terms violation
- Subscription periods longer than 1 month after 7 days from start date
11Suspension & Termination
Termination by You
You may stop using the Service at any time by simply not renewing your subscription. There is no formal cancellation process required, as subscriptions do not auto-renew.
Termination by Us
We reserve the right to suspend or terminate your access to the Service, without refund and without prior notice, if you:
- Violate any term of these Terms of Service
- Engage in fraudulent activity, including chargebacks or payment disputes
- Attempt to share credentials beyond your plan limits
- Use the Service to facilitate illegal activities
- Engage in abusive behaviour towards our staff
- Resell or redistribute the Service without authorisation
12Intellectual Property
The Emerald Stream name, logo, website design, branding, marketing materials, and any proprietary content we create are the intellectual property of Emerald Stream and protected by applicable copyright and trademark laws.
Third-party content accessed through the Service remains the intellectual property of its respective owners. Emerald Stream does not claim ownership of any third-party content delivered through our streaming infrastructure.
You may not copy, reproduce, distribute, modify, or create derivative works of any Emerald Stream-branded materials without our prior written permission.
13Limitation of Liability
To the maximum extent permitted by Irish and EU law:
Emerald Stream, its owners, employees, agents, and affiliates shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, business opportunities, or data
- Damages exceeding the amount you paid for your current subscription period
- Issues arising from third-party player apps, devices, or services
- Content unavailability or changes to the channel/VOD lineup
- Service interruptions due to factors outside our reasonable control
- Damages caused by your failure to update your player app
- Issues arising from your violation of these Terms
This limitation of liability applies regardless of the legal theory of recovery (contract, tort, negligence, strict liability, or otherwise).
14Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Guarantees of uninterrupted, error-free, or completely secure service
- Guarantees that specific channels or content will be available at all times
- Guarantees that the Service will meet your specific requirements
You use the Service entirely at your own risk and discretion. We make no representations regarding the legality of streaming specific content in your jurisdiction — it is your responsibility to comply with all applicable laws.
15Privacy & Data
Your use of the Service is also governed by our Privacy Policy, which explains what data we collect, how we use it, and your rights under GDPR and applicable Irish/EU data protection laws.
By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.
16Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last Updated" date at the top of this page
- Notify existing subscribers via WhatsApp or email for significant changes
- Make the updated Terms effective immediately upon posting
Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
17Governing Law
These Terms are governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ireland.
If you are a consumer based in the European Union, you also have the right to bring proceedings in your country of residence under applicable EU consumer protection laws.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
